These terms apply to your use of tradingcardmachine.com (the “site”), run by Trading Card Machine (“we”, “us”). Trading Card Machine is operated by . By using the site, you agree to these terms. If you don’t agree, please don’t use the site.
1. What this site is
The site gives general information about hosting one of our trading-card vending machines at your business and lets you send us a placement inquiry. We are an independent business, unaffiliated with The Pokémon Company, Nintendo, Creatures and GAME FREAK.
2. No offer, commitment or guarantee
- Nothing on the site is an offer, a contract, or a promise to place a machine at your location.
- Sending an inquiry doesn’t commit you or us to anything. Any hosting arrangement will be set out in a separate written agreement signed by both sides.
- We don’t promise or project any increase in foot traffic, sales or earnings for hosts. Results depend on location, products, pricing and many other factors.
3. Illustrations, examples and planned features
- Images on the site are illustrative concepts. The actual machine, its appearance and its placement may differ.
- The rewards program and rewards map are planned and not live. Their features, point values, rewards and participating locations may change, and they may launch later than described or not at all.
- The locations on the model map and the example reward card are examples, not real placements or customers.
4. Market information
Statistics on the site come from the third-party sources we link to and are provided for general context only. We don’t guarantee their accuracy, and they are not a forecast for any machine or location.
5. Your inquiry
Please give accurate information and only send an inquiry if you are allowed to speak for the business. Don’t include anyone else’s personal information without their permission, or sensitive information such as ID or payment details. Our Privacy Policy explains how we handle what you send.
6. Acceptable use
Please don’t misuse the site. For example, don’t:
- send spam, or automated or fake submissions;
- try to access restricted areas, such as our administration pages, without permission;
- interfere with the site’s security or operation, or upload malicious code; or
- use the site for anything unlawful.
7. Intellectual property
The site’s text, design, logo and images belong to us or our licensors. You may view and print pages to consider hosting a machine. Please don’t copy or reuse them for other purposes without our permission.
Pokémon and related names are trademarks of their respective owners, as are other product names and brands mentioned on the site. We use them only to describe the products we sell. This doesn’t mean their owners sponsor or endorse us.
8. Links to other sites
The site links to other websites, such as the sources of our statistics. We don’t control those sites and aren’t responsible for their content or practices.
9. Disclaimer
We work to keep the site accurate and available, but it is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties about the site, express or implied, including that it will be accurate, complete, uninterrupted or error-free.
10. Limitation of liability
To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special or consequential losses arising from your use of the site, and our total liability for any claim relating to the site is limited to US $100. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, willful misconduct or gross negligence.
11. Changes to these terms
We may update these terms. We will post the new version here with a new effective date. Changes apply from that date and don’t affect anything that happened before it.
12. Governing law
These terms are governed by the laws of the State of California and applicable U.S. federal law.
13. Other terms
If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still enforce it later. These terms cover your use of the site only. Purchases from our machines are covered by our Refund Policy, and any hosting arrangement will have its own written agreement.
